Network Marketing Group LLC (“NMG,” “we,” “us,” or “our”) currently operates the website at atlantaballers.com and related online services (collectively, the “Website” or the “Services”) on behalf of the Atlanta Ballers team. This Privacy Policy describes how information is collected, used, and shared in connection with the Services, and the choices available to you. It applies to the Services only and does not govern the separate practices of the Atlanta Ballers team or its other owners and operators, except as described in this Privacy Policy. We expect operation of the Website to transfer to the team’s designated operator in the future, at which time this Privacy Policy will be updated to identify that operator.

This Privacy Policy is incorporated into and subject to our Terms of Use. By using the Services or subscribing to receive communications from us, you acknowledge that you have read and understood this Privacy Policy.

Affiliates and related entities. In this Privacy Policy, “affiliates” and “related entities” means entities that control, are controlled by, or are under common ownership or control with the Atlanta Ballers team, including entities holding an ownership interest in the team and any successor operator of the Website. We may share information with our affiliates and related entities as described in Sections 3 and 5, and information may be transferred to a successor operator or other party as described in the “Business transfers” provision in Section 5.

1. Scope and audience

The Services are intended for a general audience. The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take reasonable steps to delete it.

This Privacy Policy applies only to information collected through the Services. It does not apply to third-party websites, platforms, or services that we do not own or control, including the social media and video platforms on which we maintain a presence, which are governed by their own privacy policies.

2. Information we collect

2.1 Information you provide to us

We collect information you choose to provide, including:

  • Contact and identity information, such as your email address and, optionally, your first name and city or region;
  • Preferences, such as a favorite player or team and your communication preferences;
  • Content you submit, such as information you enter into a contact, sign-up, or submission form on the Website, and comments, messages, photographs, or contest entries, where such features are made available. Submissions made through forms on the Website are processed on our behalf by a third-party form-handling provider (currently Web3Forms), which transmits the submission to us and processes it only as necessary to deliver that submission; and
  • Order information, such as details of merchandise or tickets you purchase. Payment card information is processed by our third-party payment processors and is not collected or stored by us.

2.2 Information we collect automatically

When you use the Services, we and our service providers may automatically collect:

  • Device and usage information, such as IP address, browser and device type, referring pages, pages and content viewed, links clicked, and the dates and times of access;
  • Email engagement information, such as whether you open our emails and which links you select; and
  • Cookies and similar technologies, as described in Section 6.

2.3 Information from other sources

We may receive information from service providers that assist us in operating the Services, such as analytics, form-handling, and email-delivery providers. We may also analyze publicly available content and mentions relating to our brand. We collect such information only within the categories and for the purposes described in this Privacy Policy.

Information we do not collect. We do not collect your date of birth, age, precise geolocation, or payment card information through the Services.

3. How we use information

We use the information we collect to:

  • Provide newsletters, league and team updates, and other communications you have requested, which may include promotional content and offers from our sponsors;
  • Operate, maintain, personalize, analyze, and improve the Services and our content;
  • Process and fulfill orders for merchandise or tickets;
  • Respond to your inquiries, requests, and feedback;
  • Protect the security and integrity of the Services, prevent fraud and abuse, and enforce our Terms of Use; and
  • Comply with applicable legal obligations and establish, exercise, or defend legal claims.

4. Marketing consent and advertising

Our advertising practices are limited, and we want them to be clear:

  • Marketing consent. Where our forms include a marketing-consent checkbox, we send marketing communications only to those who have opted in. You may withdraw your consent at any time as described in Section 8.
  • First-party communications. Our own communications to subscribers may include promotional content and offers from our sponsors. You may opt out of marketing communications at any time as described in Section 8.
  • No behavioral targeting of our audience. We do not build cross-context behavioral profiles of our subscribers in order to deliver advertising to them across other websites or applications.
  • No sale or sharing for cross-context behavioral advertising. We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under applicable law.
  • Third-party platforms. Third-party social media and video platforms on which we maintain a presence may engage in their own advertising and targeting using their own data and in accordance with their own policies. That activity is conducted by those platforms and is not governed by this Privacy Policy.

5. How we share information

We do not sell your personal information. We share information only as described below:

  • Service providers, who perform services on our behalf — such as website hosting, form handling and submission processing, email delivery, analytics, payment processing, and customer support — and who are authorized to use the information only as necessary to provide those services to us;
  • Legal, compliance, and safety, where we believe in good faith that disclosure is necessary to comply with applicable law or legal process, to enforce our Terms of Use, or to protect the rights, property, or safety of our users, the public, or us; and
  • At your direction, including content you choose to post or make public through the Services.

Business transfers. We may disclose or transfer your information in connection with, or during negotiations or due diligence concerning, any merger, acquisition, financing, reorganization, sale of assets, or other business transaction, including in the event of insolvency, bankruptcy, or receivership. Any party that acquires information in connection with such a transaction will be required to honor this Privacy Policy or to provide notice of any material change.

We use cookies and similar technologies to operate the Services, remember your preferences, measure engagement, and understand how the Services are used. Where required, we set non-essential cookies only with your consent through our cookie banner. Depending on your place of residence, you may have certain rights regarding your personal information, which may include the right to access, correct, delete, or obtain a copy of your personal information, and the right to opt out of certain processing. To exercise any such right, please contact us using the details in Section 13. We will verify your request and respond as required by applicable law, and we will not discriminate against you for exercising your rights.

9. Children’s privacy

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child under 13 has provided us with personal information, please contact us using the details in Section 13, and we will take reasonable steps to delete it.

10. Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

11. International users

We are based in the United States. We and our service providers process information in the United States and in other countries where our service providers operate. For example, submissions made through forms on the Website are processed by a form-handling provider whose servers may be located outside the United States. If you access the Services from outside the United States, you understand and agree that your information may be transferred to, stored, and processed in the United States and other jurisdictions, where data protection laws may differ from those of your jurisdiction.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. If we make changes, we will revise the date above and, where the changes are material, provide additional notice as appropriate. Your continued use of the Services after the effective date of a revised Privacy Policy constitutes your acceptance of the revised policy.
